General Conditions of Sale
ARTICLE 1: PURPOSE
The SASU simplified joint stock company BED REPUBLIC, registered in the Paris Trade and Companies Register under number 83853307300014 (intra-community VAT: FR67838533073), with capital of €4,000 and whose head office is located at 8 bis Rue Abel 75012 PARIS, carries out a retail trade activity of textile and furniture items via direct sales and/or via its merchant internet SITESwww.bedrepublic.eu , www.sommeil-et-tradition.fr , and www.leonis-literie.com known as “the SITES or the SITE – the SITE(s)”, hereinafter referred to as BED REPUBLIC,
These general conditions apply to the following SITES:www.bedrepublic.eu , www.sommeil-et-tradition.fr , and www.leonis-literie.com .
Article 1.1: Application of the General Conditions of Sale
These general terms and conditions of sale aim to define the conditions applicable to any purchase made through B TO C sales, known as direct sales to individuals (non-companies and B to B) via direct sales or via sales on the e-commerce merchant websites of the company BED REPUBLIC SASU, and/or via the company's websites, as well as the contractual relations between BED REPUBLIC and any adult person (18 years of age or older) with full legal capacity acting for their personal needs, non-trader, hereinafter referred to as "the CUSTOMER(s)" with a view to placing an order (hereinafter "the Order(s)") via the SITE(s).
These conditions apply to the exclusion of all other conditions, and in particular by means of other distribution and marketing channels.
For sales to professionals, specific T&Cs are also available. Refer to the B to B sales T&Cs for this.
These General Conditions of Sale are accessible at any time on the respective websites of the company BED REPUBLIC and will prevail, where applicable, over any other version or any other contradictory document.
These General Conditions are governed, interpreted and applied in accordance with French law.
Article 1.2: Final acceptance of the T&Cs
The CUSTOMER acknowledges having carefully read these General Conditions.
Before placing your order, the CUSTOMER declares to have fully read these general terms and conditions of sale and accepts them. Any order by the CUSTOMER therefore implies acceptance of all of these general terms and conditions.
By registering on the Site, the CUSTOMER confirms having read the General Conditions and accepts them, making him contractually bound by the terms of these General Conditions.
Validation of the order by the CUSTOMER constitutes express, irrevocable and unreserved acceptance by the CUSTOMER of the terms of these general conditions of sale which will prevail over any other general or specific conditions not expressly agreed to by BED REPUBLIC.
Article 1.3 Modification of the General Conditions of Sale
BED REPUBLIC reserves the right to modify its general terms and conditions of sale at any time. The applicable general terms and conditions of sale are those in force on the date of the order by the CUSTOMER.
In the event of modification of the T&Cs, the applicable version of the T&Cs is that appearing online on the SITE at the time of the order.
The General Conditions applicable to the CUSTOMER are those available on the date of the order, a copy of which dated on that date may be provided to the CUSTOMER upon request. It is therefore specified that any modification to the General Conditions which may be made by BED REPUBLIC will not apply to any order placed previously, unless expressly agreed by the CUSTOMER at the origin of a given order.
Article 1.4. Partial nullity/divisibility
If one or more provisions of the T&Cs are deemed invalid, void or inapplicable for any reason whatsoever, or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions of the contract will retain their full force and scope.
This said “condition” shall be deleted and shall not affect the validity and enforceability of any remaining condition. NOTHING IN THESE TERMS SHALL AFFECT ANY NON-WAIVERABLE STATUTORY RIGHTS THAT APPLY TO YOU.
Article 1.5. Non-waiver
The fact that one of the parties to the T&Cs has not required the application of any clause, whether permanently or temporarily, may not under any circumstances be considered as a waiver of the rights of that party arising from said clause.
The failure to exercise any right, in whole or in part, or waiver of any breach of these Terms will not prevent BED REPUBLIC from further exercising that right and will not constitute or indicate a waiver of any subsequent breach.
BED REPUBLIC's rights and remedies under these Terms and any other applicable agreement between CUSTOMER and BED REPUBLIC shall be cumulative, and the exercise of any such right or remedy shall not limit BED REPUBLIC's right to exercise any other right or remedy.
ARTICLE 2: LEGAL MAJORITY
By validating these general conditions when ordering, the CUSTOMER declares that they have the legal capacity to enter into a contract, i.e. that they are of legal age and not under guardianship or curatorship.
ARTICLE 3: PRE-CONTRACTUAL INFORMATION
Article 3.1: Prerequisites
The CUSTOMER acknowledges having received communication, prior to the immediate purchase or the placing of his order and the conclusion of the contract, in a clear and comprehensible manner, of these general conditions of sale known as GTC, and of all the information listed in article L.221-5 of the Consumer Code and in particular the following information:
The essential characteristics of the Product;
The price of the Services and additional costs (delivery, for example);
In the absence of immediate execution of the contract, the date or period by which the Company undertakes to provide the Services ordered;
Additional information or mentions of any nature whatsoever, communicated before any final conclusion of the contract
ARTICLE 4: PRODUCTS
Article 4.1: Conditions of offers
The entire range of products and prices are defined by the BED REPUBLIC company.
BED REPUBLIC manufacturers and suppliers may be required to modify the technical composition of product references without notice. BED REPUBLIC may then, at any time, update, improve the product sheets or withdraw its products from sale.
All products offered by BED REPUBLIC comply with the legislation and standards applicable in the countries where the offer is marketed.
The CUSTOMER is invited to read the instructions for use or any other information attached to the product or on the product or its packaging, in particular information relating to any precautions for use, guarantees, conditions and restrictions of use, and maintenance.
The products in the catalog are accompanied by technical descriptions and photographs that reproduce them as faithfully as possible, within the limits of technology and in compliance with the best market standards. This information may be present in paper form or by internet link to this information, which can be consulted at any time. The absence of technical data or instructions cannot be the subject of a refusal or withdrawal of the sale and BED REPUBLIC cannot be held liable, including in the event of an assembly error.
The perfect representation of the products on the SITE cannot be guaranteed, in particular due to differences in the rendering of colors or materials on the internet browsing software and/or the viewing media used. The CUSTOMER does not have any rights derived from typographical errors, product descriptions or other obvious errors on the WEBSITE.
Slight color differences and other variations in the Products may be detected as a result of the use of different technologies in the presentation of images, the display of these or for other technical reasons. BED REPUBLIC is not responsible for these variations and deviations.
BED REPUBLIC undertakes to describe its products as accurately as possible and to give the highest fidelity to all the elements present on the SITE, in its descriptions and in the different sections of the SITE. If errors or omissions were found concerning these presentations or the description of the products, BED REPUBLIC could not be held liable.
Article 4.2: Order validation process
It is up to the CUSTOMER to select the products they wish to order on the SITE, according to the following terms:
The CUSTOMER places his order from the online catalog. The conclusion of the order takes place in 4 successive stages: summary of the product ordered, identification of the CUSTOMER, payment and final validation.
The information provided by the CUSTOMER is his/her sole responsibility. In the event of an input error, BED REPUBLIC cannot be held responsible for the impossibility of delivering the items ordered.
Automatic recording systems are considered as proof of the nature of the content and the date of the order, the latter will be validated by a confirmation email to the CUSTOMER at the address entered by the CUSTOMER.
The sale will only be considered final after the order confirmation email has been sent to the CUSTOMER and payment has been duly accepted, confirmed and received in the bank account of the company BED REPUBLIC.
The CUSTOMER has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance.
This validation implies acceptance of all the general conditions of sale and constitutes proof of the sales contract. It is therefore up to the CUSTOMER to verify the accuracy of the order and to report any errors.
Any order placed on the BED REPUBLIC SITES constitutes the formation of a sales contract between the CUSTOMER and the seller.
BED REPUBLIC reserves the right to cancel any order from a CUSTOMER with whom there is a dispute over a previous order. Orders are processed by our services from Monday to Friday excluding public holidays and periods defined as "holidays" by management. Delivery times are applicable on the date the order form is recorded by our services.
Article 4.3: Availability of products
BED REPUBLIC offers are valid subject to availability. In this context, information on the availability of products will be provided to the CUSTOMER directly on their product sheet.
In the event of unavailability of products during the processing of your order by BED REPUBLIC, we will notify the CUSTOMER by email or telephone, in order to offer:
Or the new product availability time.
Or a possible replacement for equivalent equipment, of the same category and at least the same quality.
Either the same item in another color or another material.
Either cancel the sale and refund you the price paid for the unavailable product.
No additional costs or compensation greater than the total amount paid for the order may be requested in the event of unavailability of the product.
ARTICLE 5: PRICE
Article 5.1: Applications
The prices charged are those applied at the time of the order within the limit of available products and/or stocks. The prices appearing on the BED REPUBLIC SITE are exclusively expressed in the local currency of the country concerned, are exclusive of shipping costs and All Taxes Included (TTC), excluding customs taxes applicable depending on the delivery zones/countries and/or any other type of mandatory tax arising from the order process.
Any change in VAT will be automatically reflected in the price of the products.
Prices are subject to change at any time without notice.
It is also appropriate to add the possible cost of transport, calculated automatically according to the nature of the items ordered and the mode of transport selected. The delivery costs displayed beforehand in your basket correspond to the delivery costs calculated automatically according to the default carrier for your selected items and are likely to vary.
In the event of free shipping, no charges will be requested from the CUSTOMER, in accordance with the criteria given for the allocation of free shipping.
In the case of cross-border deliveries (purchase outside the European Community), the user must pay the taxes and/or fees (e.g. customs duties) that are required by the customs authorities or the prosecutors legally competent in your specific case; as well as the organization of the transport of said deliveries.
BED REPUBLIC will not be able to bear any customs surcharges requested by the country upon delivery to the CUSTOMER.
Article 5.2: VAT – countries concerned by the sale/shipment – exceptions to shipping costs

Additional shipping charges will apply for the following countries:

Additional shipping costs may be applied for specific delivery areas, peninsular areas and giving rise to additional transport charges, in view of access difficulties known and recognised by the carriers (peninsular islands of certain countries, specific areas, etc.).

The precise list of postal codes by country can be found at the end of the T&Cs in the appendix.
These specific destinations and postal codes are applicable to a logistics surcharge for delivery to the final CUSTOMER (except promotional act or mentioned in the end of order validation basket).
Article 5.3: cases outside the EU - Switzerland (as of 2024)
For Switzerland, the price includes Swiss VAT, logistics costs may be applied and customs fees paid by the CUSTOMER upon receipt of the product may apply (if applicable excluding new application on 01/01/2024 of exemption from customs duties). If the VAT rate in force were to be modified, the prices of the items could be modified accordingly, without the CUSTOMER being informed in advance. Invoicing is done at the rate in force at the time of registration and acceptance of the order.
Prices do not include customs fees to be paid by the final CUSTOMER.
The CUSTOMER has an obligation when delivering to Switzerland to know their rights and taxes/amounts to pay, and BED REPUBLIC would not be responsible for these costs, or even provide an education on the legislation in force.
The prices displayed do not include any additional logistics costs or customs fees that the CUSTOMER, importing into Swiss territory, will have to pay or not, depending on the nature of their order and the regulations in force in Switzerland.
The products remain the property of BED REPUBLIC until full payment of the price and their delivery. This price is payable in full and in a single payment (except for a specific payment arrangement in several installments).
BED REPUBLIC cannot be held responsible for the impossibility of delivery or the impossibility of paying any additional costs and customs fees that the CUSTOMER must pay; therefore, the CUSTOMER will be responsible for the full payment of these possible costs.
In the event of non-payment of the additional required fees, cancellation during delivery, or refusal of delivery, BED REPUBLIC reserves the right to refuse delivery and to pay, as a deduction from the CUSTOMER refund, the fees inherent to the cancellation/non-delivery of the order.
ARTICLE 6: ORDER
Article 6.1: Order Process
Prior to their first order, the CUSTOMER agrees to create a CUSTOMER account on BED REPUBLIC by providing certain information enabling the management of the order and delivery, including:
His first and last name
His or her complete and detailed postal address(es)
Their valid email address required to confirm the order
His or her phone number(s).
Essential information necessary for the delivery of the product.
All of this information is protected by a personal password entered by the CUSTOMER himself and modifiable at will by him alone.
The CUSTOMER's order is carried out in the following 5 steps: cited in the following articles 6.1.XXX.
Article 6.1.1: Placing the order
This step consists of the validation by the CUSTOMER of the items (references and quantities) chosen for their order and added to the basket.
The CUSTOMER can then enter a promotional code allowing them to benefit from reductions, delete one or more products or modify the quantity.
Article 6.1.2: Contact details
It consists of the CLIENT entering the identification elements and information necessary for the smooth running of the order, namely in particular the following elements: first name, last name, full delivery details, billing address, etc.
ATTENTION: All orders will be delivered to the address stipulated when identifying yourself on BED REPUBLIC.
The CUSTOMER must verify the accuracy and conformity of the information provided regarding the delivery address. In the event that the CUSTOMER wishes a delivery different from that proposed when entering your administrative data, the CUSTOMER must modify or add a new delivery address and check that it has been selected when placing the order. If the CUSTOMER notices an error, please contact the BED REPUBLIC teams as soon as possible by email at contact@bedrepublic.fr using the order confirmation email, in order to request that the typographical error be corrected. Otherwise, BED REPUBLIC cannot be held responsible for the errors given.
In the event of a delivery error and for any CUSTOMER error, the amount of the reshipment will be borne by the CUSTOMER.
To do this, the CUSTOMER must create an “account” and choose a username and password.
If the CUSTOMER has already ordered on the BED REPUBLIC SITE, these identification and information elements will have been recorded; he will then have to recall his account (by entering his username and password); once connected to his account, the CUSTOMER can modify, if necessary, his contact details.
The CUSTOMER shall refrain from any disruption of the WEBSITES and from the use of any accessible information other than its intended use on our platform. Any manipulation of our WEBSITE in order to fraudulently obtain money or any other advantage at the expense of BED REPUBLIC or any other user will result in legal action and loss of access to the WEBSITES.
Article 6.1.3: Choice of delivery method
This step specifies the delivery times and methods. Orders are currently delivered by several carriers. The choice of carrier depends on the products added to the basket.
Delivery will be made to the address indicated by the buyer when ordering on the WEBSITE. The products ordered may be subject to multiple deliveries (not guaranteed at one time).
Depending on the selected carrier and the country of destination of the delivery, in the majority of cases and depending on the service provider and the nature of the product, the delivery service provider may contact the CUSTOMER by multiple means (email, telephone, text message, application, etc.) to mutually agree on the delivery dates and time slots. The buyer undertakes to be present on the date, time and place agreed for the delivery, if this is the case.
Please note that this appointment is not obligatory, depending on the nature of the products ordered, but also the transport provider chosen, and cannot constitute a cancellation of the contract in the event of unannounced delivery.
If the CUSTOMER is absent during delivery, a delivery notice will be left, the carrier will propose a new appointment for delivery or the procedure to collect the package. Cancellation of the order when the delivery has failed twice, and within a maximum handling period of 15 days of availability at a collection point geographically close to the CUSTOMER and in the event of non-handling by the CUSTOMER, means that the CUSTOMER authorizes BED REPUBLIC to keep the delivery costs; additional costs may or will be applied depending on the case.
Article 6.1.4: Payment
When the CUSTOMER clicks on the “Validate” button after the order process, the CUSTOMER declares that they accept the order and all of these General Conditions of Sale fully and without reservation.
The data recorded by BED REPUBLIC constitutes proof of all transactions carried out by BED REPUBLIC and its CUSTOMERS.
CB bank card payment:
The data recorded by the payment system constitutes proof of financial transactions.
Payment by credit card is made in the last step, after validation of your basket; the CUSTOMER automatically switches to a secure page of the banking establishment/online payment providers when ordering, via the cards accepted by our various payment providers.
The SITE's payment providers are: Shopify Pay, PayPal, Stripe payments.
The SITE allows the CUSTOMER to pay for their order directly online 24 hours a day, 7 days a week. The CUSTOMER's information is encrypted using the SSL protocol and secured by our payment providers offered when validating the basket.
The order validated by the CUSTOMER on the WEBSITE will only be effective when the central bank card network has given its agreement. In the event of refusal of the latter, the company BED REPUBLIC reserves the right to cancel the order and not to proceed with the shipment.
BED REPUBLIC reserves the right not to accept any order, even if this procedure is followed, in the event of suspected fraud or in the event of non-receipt of funds into its bank account.
Payment by bank transfer:
In case of payment by bank transfer, BED REPUBLIC will proceed with the shipment only after receiving the actual proof of payment and its actual and certified confirmation by the bank receiving the funds in the bank account of the company BED REPUBLIC.
To confirm the first step of payment validation by transfer, before verification by the accounting team of the presence of funds, the CUSTOMER undertakes to send a copy of the proof of the bank transfer to BED REPUBLIC, to be sent by email to contact@bedrepublic.fr, indicating in the subject of the email the order number and the name of the buyer.
BED REPUBLIC reserves the right not to accept any order, even if this procedure is followed, in the event of suspected fraud or in the event of non-receipt of funds into its bank account.
Article 6.1.5: Confirmation
It consists of the final validation of the order.
The CUSTOMER's order will be confirmed by email. This email confirms that the CUSTOMER's order has been taken into account by BED REPUBLIC. The delivery time will begin from the date of receipt of this email. The order is validated once payment has been accepted.
BED REPUBLIC undertakes to confirm each order placed by sending an email. This email confirms that the order has been taken into account and that the amount of the order has been debited. After sending the order confirmation email, BED REPUBLIC cannot guarantee that the CUSTOMER will be able to cancel the order.
In the event of unavailability of a product, BED REPUBLIC will contact the CUSTOMER to offer another choice, which are listed in article 4.3 of the T&Cs.
BED REPUBLIC reserves the right to cancel or refuse any order from a CUSTOMER with whom there is a dispute relating to the payment of a previous order or a suspicion of possible fraud.
Article 6.2: Modification of order
Any modification of the order by the purchasing CUSTOMER can only be taken into consideration if it is notified in writing (letter, telephone or email) before shipment of the products.
If the CUSTOMER needs to make a modification or cancellation, we invite them to contact BED REPUBLIC as quickly as possible by email at the following address: contact@bedrepublic.fr
BED REPUBLIC reserves the right to refuse or to be unable to honor the CUSTOMER request, in the event of an error or modification of the requested order.
Article 6.3: Verification of payments
In order to protect itself from fraudsters, the BED REPUBLIC team checks each order placed.
To this end, and before shipping your order, BED REPUBLIC reserves the right to ask the CUSTOMER for all documents necessary to prove identity or delivery address (ID, proof of address, etc.).
These documents are requested by telephone or by email, in particular for all new CUSTOMERS.
BED REPUBLIC reserves the right not to accept any order, even if this procedure is followed, in the event of suspected fraud or in the event of non-receipt of funds into its bank account.
No personal data, or personal and secret codes may be requested by the BED REPUBLIC teams (never!): credit card data, identification data, access codes... if people pretend to be BED REPUBLIC requesting this type of information, stop all communication and contact our CUSTOMER service.
Article 6.4: Discount code
BED REPUBLIC may offer confirmed consumers “gift codes” or “promotional codes” through a variety of promotional activities and communications that can be redeemed for a purchase on the BED REPUBLIC company SITES. Other restrictions may be decided and communicated by BED REPUBLIC at the time of making the offer codes available and/or on the WEBSITE in relation to the products concerned.
Only valid offer codes provided or promoted by BED REPUBLIC will be considered for purchase. Codes provided or promoted by third parties not authorized by BED REPUBLIC (including unauthorized third party SITES) will not be considered valid. Each promotional code promoted by BED REPUBLIC is non-transferable and valid for a single use on one or more items of merchandise as determined by BED REPUBLIC. Some promotional codes may be combined.
CUSTOMERS are limited to using one unique promotional code per order.
Coupon codes cannot be used to purchase unmarked merchandise or shipping charges. For online purchases, the code must be entered in the appropriate field at checkout. Coupon codes are not redeemable in showrooms or stores and are only valid online.
BED REPUBLIC is not responsible for lost, stolen, corrupted codes or any unauthorized use of codes. Offer codes cannot be redeemed for cash or cash equivalents. No substitutions or credits will be allowed. Cash The value of an offer code will not be refunded or credited if any or all merchandise is returned. Expiration dates may apply to each promotional code.
BED REPUBLIC may occasionally engage spokespersons, influencers, bloggers or other individuals or entities who have been paid or incentivized to speak on behalf of the brand. If you receive a promotional code through a third-party source, such as a television or radio host, please note that these individuals may have been compensated by BED REPUBLIC for their statements, and must indicate this as a commercial partnership - commercial communication.
BED REPUBLIC reserves the right to cancel or refuse any order from a CUSTOMER, without justification, with whom there is suspicion of fraud or inappropriate, abusive or non-referenced use by BED REPUBLIC of discount/promotional codes.
Article 6.5: Cancellation of order
In the event of an order cancellation, before your packages are shipped, you must inform us of your decision by contact form or via our contact email: contact@bedrepublic.fr .
The BED REPUBLIC Team will proceed to cancel the order provided that it has not already been prepared by the BED REPUBLIC shipping department.
BED REPUBLIC will reimburse the amounts received within a maximum of 30 days after receipt of the CLIENT email.
In the event of cancellation after the order has been shipped, the procedure will be different as it will apply the rules of the right of withdrawal defined in article 7.
BED REPUBLIC reserves the right to cancel or not validate an order for which the payment of this order or a previous order from the CUSTOMER presents a dispute.
ARTICLE 7: RIGHT OF WITHDRAWAL
Article 7.1: Right of withdrawal
In accordance with Article L. 221 – 18 et seq. of the Consumer Code, the CUSTOMER has a withdrawal period of 14 clear days from the date of receipt of their order to return any item that does not suit them, in its original packaging and in perfect condition, and request a refund of the sums paid, including shipping costs.
To exercise his right of withdrawal from the Order, the CUSTOMER must notify his decision to withdraw by means of an unambiguous statement, without providing reasons. The CUSTOMER must make his request by email or via the messaging/contact form. The withdrawal form is available here or via our contact form and/or by sending an email to contact@bedrepublic.fr.
In accordance with article L221-23 of the consumer code, the CUSTOMER is informed that he will have to bear the direct costs of returning the goods.
Gift cards have a withdrawal period of 14 calendar days from the date of receipt of the gift card by the buyer.
Article 7.2: Procedures for exercising the right of withdrawal
BED REPUBLIC will reimburse the CUSTOMER for the price of the product and the corresponding shipping costs as soon as possible and no later than 30 days from receipt of the package, provided that the product is returned complete, in perfect condition and in its original packaging following the procedure described in article 10.5 “Returns”.
- In case of payment by bank card, the refund will be made directly to the CUSTOMER's account linked to the bank card.
- In the event of payment in several installments, the reimbursement will be made directly to the CUSTOMER's account in the month of each direct debit.
- In case of payment by bank transfer, the refund will be made directly to the bank account of the CUSTOMER who made the payment. No refund to an account other than the one used for payment can be made.
- In the event of a failure to be reimbursed, the reimbursement will be made by bank transfer from BED REPUBLIC, which will ask the CUSTOMER for a valid RIB + documents proving the validity of the bank account given by the CUSTOMER; in the absence of a transfer, the reimbursement by kitty will be made, on the SITE. No payment by check or cash will be made.
The CUSTOMER may, if they wish, use the services of BED REPUBLIC carriers to collect their order. In this case, contact CUSTOMER Service via the Contact Form .
The amount of the return costs will be calculated based on the type of product and the distance to be covered by the carrier to collect the product and return it to the warehouse. This can also be defined by our transport service price list, depending on the nature and the chosen recovery package. The costs to be paid by the CUSTOMER may be higher than the costs paid by the CUSTOMER when purchasing.
For any purchase made in one of our stores, distributor stores, via our resellers or commercial agents, opened, used, or by judgment of BED REPUBLIC, no withdrawal will be accepted: the products are neither returned nor exchanged.
Products that are incomplete, damaged, soiled, poorly packaged or unable to be repackaged and/or have a hygiene defect will be subject to depreciation on the amounts to be reimbursed.
In the event of an anomaly on the product, if the product can be reconditioned, an exchange or compensation and an investigation must be established by BED REPUBLIC, by contacting our CUSTOMER AFTER-SALES service.
In the case of an exchange of size of a product of the same category initiated by the CUSTOMER for reasons other than those related to a material or manufacturing defect, the withdrawal period is interrupted upon validation of this exchange by the CUSTOMER.
In the case of a mattress still packaged and compressed. Mattresses must be opened within 30 days of delivery. BED REPUBLIC does not take back mattresses still packaged in the cardboard after 30 days of delivery.
ARTICLE 8: PAYMENT TERMS
Article 8.1: Secure payment
The BED REPUBLIC company offers you several types of payments on its online store, all 100% secure.
In order to provide the CUSTOMER with the best security guarantees for the payment of their online purchases on the SITE, BED REPUBLIC has chosen the most well-known and secure payment organizations:
PayPal, Shopify Payment and Stripe.
These companies ensure flawless security thanks to proven cryptography techniques, meaning that all sensitive information is encrypted and only these banks can process it and ensure the link between the bank and BED REPUBLIC.
No credit card number is stored at BED REPUBLIC.
No personal data, or personal and secret codes may be requested by the BED REPUBLIC teams (never!): credit card data, identification data, access codes... if people pretend to be BED REPUBLIC requesting this type of information, stop all communication and contact our CUSTOMER service.
Article 8.2: Means of payment
The CUSTOMER undertakes to read the specific terms and conditions of sale and use of the online payment service providers and credit institutions before using the corresponding payment and credit services on the respective SITE.
Payment by bank card (CB, Visa, MasterCard)
This type of payment is completely secure via BED REPUBLIC's payment providers. This type of payment is recommended and strongly recommended due to its high levels of security. The CUSTOMER's bank details are encrypted using the TLS (Transport Layer Security) protocol, formerly SSL (Secure Sockets Layer) used by most web browsers. You can tell that a transaction is encrypted when a key or a closed padlock appears in the lower corner of the screen and on the left in the address bar, the address begins with https://...
Information never passes through the network in clear text. Payment is made directly to the payment organization on its page. The additional identification "Secure Code" and/or "Verified by Visa" provides the CUSTOMER with even more security against possible fraud or attempted fraud. This security is necessarily carried out on the secure server of the CUSTOMER's bank, via several solutions personal to the CUSTOMER; any negative response from this identification will not allow you to validate your order.
The CUSTOMER pays immediately during the ordering process by entering their bank card details. The frameworks processing bank card data are provided by Stripe , PayPal and Shopify Payments are approved by the Prudential Control and Resolution Authority as an electronic money institution.
Payment by PayPal
The CUSTOMER pays directly via their PayPal account, which they must have previously established.
When submitting your order, the CUSTOMER will be redirected to PayPal to authorize the payment of the order value. PayPal is duly authorized in Luxembourg as a bank (or "credit institution" in legal terms). Please accept the terms of use of this organization.
Payment by Bank Transfer
Payments by bank transfer are made in full upon ordering. After validation of the order, the CUSTOMER has approximately 7 days to send your transfer to the BED REPUBLIC bank account, the references of which will be communicated to the CUSTOMER on the order confirmation page as well as by email. The order will be validated by BED REPUBLIC services upon receipt of the CUSTOMER payment. After this period, the order will be cancelled.
In case of payment by transfer, the delivery times indicated when ordering may be extended.
Until BED REPUBLIC receives full payment from the CUSTOMER, the products ordered are not reserved. BED REPUBLIC cannot therefore be held responsible for any shortages due to the time taken to receive the funds.

Article 8.3: Terms of exercise and cancellation
Payment should be made by indicating the order reference concerned, and taking into account the validation period involved.
All payments are made by default in euros (€), and it is the CUSTOMER's responsibility to bear, at their own expense, any transaction and exchange fees via the various payment methods offered, in the event of payment in another currency. Any payment received in another currency, without the agreement of BED REPUBLIC, may result in a refusal of the order.
The CUSTOMER agrees to receive invoices and credit notes exclusively in electronic form. It is the CUSTOMER's responsibility to save and print the payment invoice if he wants to keep the details of the transaction.
For each order, BED REPUBLIC reserves the right not to offer certain payment methods depending on the delivery address, a discrepancy with the delivery and billing address, the value of the goods in the order or due to other objective criteria.
BED REPUBLIC retains full ownership of all products sold until full payment, including all applicable fees, taxes and mandatory contributions, is received.
ARTICLE 9: SHIPPING AND DELIVERY CONDITIONS
Article 9.1 – Prerequisites for order validation
Prior to any purchase, the CUSTOMER must ensure that each product ordered can be delivered without difficulty. He must therefore take all necessary measures to ensure the smooth running of his delivery, in order to check that the dimensions of the packages are not incompatible with the constraints specific to his home (elevators, stairs, corridors, doors, etc.).
The CUSTOMER is responsible for the information (delivery address, email address, name and telephone number) that he/she provides when placing his/her order. BED REPUBLIC cannot be held liable in the event that an error prevents or delays delivery.
In the event of difficulty encountered during the delivery of the products, for which the CUSTOMER is solely responsible, the costs incurred by a new delivery of the products would be borne by the CUSTOMER.
If there are any constraints preventing delivery to the home, the CUSTOMER will not be able to refuse delivery. The CUSTOMER will not be able to hold BED REPUBLIC liable and the return costs will be at their expense.
The rates for deliveries outside the areas where BED REPUBLIC offers free delivery are indicated when placing the order. For areas outside the European Union, taxes and customs fees may be claimed by the carrier.
For any type of delivery outside the areas offered and listed, this must be the subject of a request and an agreement between the CUSTOMER and BED REPUBLIC.

Article 9.3 – Delivery terms
The products ordered are delivered to the address indicated by the CUSTOMER during the ordering process.
The delivered products are accompanied by a delivery note (paper or electronic). The CUSTOMER undertakes to check the conformity of his order upon receipt and to SIGN imperatively with the same signature as that present on his identity document, the delivery note provided by the carrier.
The CUSTOMER may be contacted (not obligatory) by the carrier after his Order (by telephone, email or SMS) in order to arrange an appointment for the delivery of the orders.
The information will be provided by BED REPUBLIC in advance, by shipping notification. In case of notification by BED REPUBLIC will be considered as CUSTOMER contact for delivery planning.
The appointment will be made according to the availability of the CUSTOMER subject to the availability of the carrier. A delivery slot will be communicated to the CUSTOMER by the carrier (not obligatory).
This slot is imposed by the carrier and the CUSTOMER must make themselves available.
Making an appointment is not obligatory, depending on the nature of the product ordered, the delivery method chosen and the carrier used, and cannot constitute a cancellation of the contract in the event of unannounced delivery.
In the event of the absence of the CUSTOMER at the address indicated on the day of delivery, or in the event of an error made by the CUSTOMER in indicating the delivery address, the costs incurred by a new delivery service shall be borne by the CUSTOMER.
BED REPUBLIC can offer different delivery services: to the door, upstairs in the desired room or upstairs in the desired room + installation of the furniture (for eligible products only).
In the case of standard deliveries (not mentioned), BED REPUBLIC is not authorized to deliver in its STANDARD delivery process, if other choices are not offered, its products in areas not accessible by road, except by agreement and payment of additional costs by the CUSTOMER.

Article 9.4 – Type of deliveries

Delivery carried out by a specialized carrier. The delivery of the products is carried out at the bottom of your house, at the foot of the truck or at the doorstep, depending on the nature of your access.
Before placing an order, the CUSTOMER must check that he can receive the order himself, be authorized to sign the delivery note, not obstruct or leave the order on the public highway and move the products received by his own means to his home.
After the order has been shipped, depending on the product and volume, the carrier mandated by BED REPUBLIC may - without obligation or obligation of result - contact the CUSTOMER by several means of communication provided: emails, telephone, text messages, etc. to arrange a delivery appointment, and or inform the CUSTOMER of their next delivery. The information will be provided by BED REPUBLIC in advance, by shipping notification. In the event of no contact or notification by the carrier, the shipping information provided by BED REPUBLIC will be considered as the CUSTOMER contact for delivery planning.

Article 9.4.2 – Comfort delivery to the desired room
Delivery carried out by a specialized carrier. The delivery of the products is made to the CUSTOMER's home, in the room of their choice.
After the order has been shipped, the carrier mandated by BED REPUBLIC will contact the CUSTOMER to arrange a delivery day: the appointment slot is a full day. In the event of the CUSTOMER's absence at the appointment, the costs incurred by a new delivery would be at their expense. Within 48 hours before delivery, the CUSTOMER will be able to track the progress of their package using a link sent.
When making an appointment, the CUSTOMER will inform the carrier of all the arrangements for access to his home. Beforehand, the CUSTOMER will have checked the size of the products to allow their passage without difficulty.
In the event that it is necessary to rent a lift or a basket, the additional costs will be borne by the CUSTOMER and invoiced by the carrier in addition to the sale price and the delivery costs mentioned on the SITE. In the event that 4 delivery people need to pass through (stairs too narrow, road inaccessible for a truck, etc.), the additional cost will be borne by the CUSTOMER.
Article 9.4.2 – Premium delivery to the desired room with product assembly
Delivery carried out by a specialized carrier. The delivery of the products is made to the CUSTOMER's home, in the room of their choice. The assembly service of the product(s) ordered is included.
After the order has been shipped, the carrier mandated by BED REPUBLIC will contact the CUSTOMER to arrange a delivery day: the appointment slot is a full day. In the event of the CUSTOMER's absence at the appointment, the costs incurred by a new delivery would be at their expense. During shipping and before delivery, the CUSTOMER will be able to track the progress of their package using a link sent.
When making an appointment, the CUSTOMER will inform the carrier of all the arrangements for access to his home. Beforehand, the CUSTOMER will have checked the size of the products to allow their passage without difficulty.
In the event that it is necessary to rent a lift or a basket, the additional costs will be borne by the CUSTOMER and invoiced by the carrier in addition to the sale price and the delivery costs mentioned on the SITE. Article 9.5 – Delivery times
Estimated delivery times are indicated on each product sheet. They depend in particular on the availability of the products and their stage of production, mentioned in an estimated manner.
For pre-ordered products this period is extended, you must then take into account the estimated delivery date indicated on each product sheet.
In the event of a delivery problem, BED REPUBLIC undertakes to make its best efforts to keep the CUSTOMER informed of any delay in delivery. BED REPUBLIC shall not be held liable if the delivery delay is due to a case of force majeure.
When the CUSTOMER orders several products at the same time and these have different shipping times, the shipping time of the order is based on the longest time.
In the case of a multi-product order, depending on the location of the different items ordered, delivery may be made in several times. Receipt in several times, on staggered dates (not grouped) of all the items in the order is a very common point in the activity of delivery of products sold by BED REPUBLIC, and cannot lead to a partial or complete cancellation of the order for this reason.
Late receipt of the order or part of the order (out of time) cannot be considered as a reason for cancellation.
Article 9.6 - Steps to follow upon delivery
IMPORTANT: In order to assert their warranty and return rights, the CUSTOMER undertakes to carefully check the condition of the goods (packaging and product) in the presence of the delivery personnel, before signing the delivery note .
THE CUSTOMER MUST IMPERATIVELY CHECK:
- The correct correspondence of the products ordered with those indicated on the delivery note.
Please note that the internal references to the supplier BED REPUBLIC cannot be read by the CUSTOMER, in order to refuse his order. It is important to note that the majority of our shipments are indicated as NESTA HOME or BED REPUBLIC, and this will be taken as proof on the delivery reference.
It is important to confirm the nature of the product ordered, in order to validate its refusal or cancellation.
- The number of packages (it must correspond to that indicated on the delivery note)
- The condition of the packages: the slightest shock, the slightest anomaly must be reported by the CUSTOMER on the delivery note, in the REMARKS section. If a package is damaged, the CUSTOMER MUST open it in front of the delivery person to check the condition of the product. If the delivery person refuses to wait, the CUSTOMER must indicate this on the delivery note.
Except in the case of defective products, the products are deemed to have been accepted by the CUSTOMER and to comply with the order, unless the CUSTOMER has issued written reservations to the carrier under the conditions provided for by law:
- Appropriate reservation(s) mentioned on the delivery note
- Confirmation of said reservations by registered letter with acknowledgement of receipt addressed to the carrier within 3 days of receipt (art. L. 133-3 of the Commercial Code).
PLEASE NOTE: The words “subject to unpacking” are not acceptable with our carriers.
Article 9.7 – Mandatory delivery information
IMPORTANT: THE CUSTOMER MUST ALWAYS and SYSTEMATICALLY LEAVE a comment on the delivery note (even to confirm its correct receipt) in order to be able to turn to the transport provider in the event of a dispute.
WITHOUT RESERVATIONS and COMMENTS on the delivery note, BED REPUBLIC will be unable to open a dispute file with the carrier in the event of a dispute, and the CUSTOMER claim will then be unfeasible, failing which the delivery person cannot be held liable.
This may result in BED REPUBLIC refusing to take charge of the CLIENT dispute.
According to article 138-4 of the Consumer Code which provides that "Any risk of loss or damage to the goods is transferred to the consumer at the time when the latter or a third party designated by him, and other than the carrier proposed by the professional, takes physical possession of these goods.", it is the CUSTOMER's responsibility to check the products delivered upon receipt.
If the delivery is correct: the CUSTOMER must state “Good condition” or “OK” on the delivery note.
If the delivery is not compliant: the CUSTOMER must clearly mention the problem encountered on the delivery note and refuse the package(s) if the anomaly is visible. The CUSTOMER must then contact BED REPUBLIC within 48 hours to find a solution to their problem.
In the absence of specific reservations made by the CUSTOMER, the delivery will be presumed to be compliant. No claim can therefore be accepted if the CUSTOMER does not scrupulously follow this procedure.
If the CUSTOMER has nevertheless kept the product even though it was damaged upon delivery, he must describe in detail on the delivery note the damage encountered and send a registered letter (by post or email) to the carriers within 48 hours of delivery to explain the delivery problem encountered. In this way, immediate contact with our CUSTOMER service, without delay, is imperative: contact@bedrepublic.fr clearly explaining the problem encountered, with photos and videos to support the file. BED REPUBLIC will do its best to support the CUSTOMER in any claim he may have against the service provider.
Article 9.8 – Liability
BED REPUBLIC reserves the right to choose the carrier and guarantees the proper delivery of the products without prejudice to its right of recourse against any service provider having intervened. However, BED REPUBLIC may exonerate itself from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the CUSTOMER or to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure.
The risks of loss or damage to the Products are transferred to the CUSTOMER at the time when he, or a third party designated by him, takes physical possession of the Product(s) without distinction according to its/their nature.
The Product, which is delivered to the CUSTOMER by a carrier chosen by BED REPUBLIC, travels at the risk and peril of BED REPUBLIC within the framework of the normal application contract (excluding specific sales contracts). The Product, which is delivered to the CUSTOMER by a carrier chosen by itself, travels at the risk and peril of the CUSTOMER from the delivery of the goods to the carrier (contract or specific request).
It is not BED REPUBLIC's responsibility to ensure that the person accepting delivery at the address provided by the CUSTOMER is the person holding the order (or is someone authorized by the CUSTOMER to accept delivery of the products). The products are delivered only by the partner carrier who makes the delivery on behalf of BED REPUBLIC to the address indicated when you place your order.
BED REPUBLIC is not responsible for delays that occur due to circumstances beyond our control.
In the unlikely event that, after the conclusion of the contract for the purchase of the Products, BED REPUBLIC is unable to deliver the order (or part thereof) and BED REPUBLIC is not responsible for this, BED REPUBLIC is entitled to terminate the contract for the purchase of the Products in question. In such a case, BED REPUBLIC will inform as soon as reasonably possible and reimburse the CUSTOMER for all payments made.
BED REPUBLIC will do its best to support the CLIENT in any claim it may have against the service provider.
For logistical reasons, BED REPUBLIC reserves the right to split shipments, and cannot be subject to refusal/cancellation of an order by the CUSTOMER in the event of partial, part, or complete and final receipt of the order.
Article 9.9 – Partner resale and contact
Any order of our products via products via RESELLERS: reseller, distributors, agents, stores, partner stores and partner online sales SITES, marketplace, private sales, discounters or clearance sellers, must be managed by the CUSTOMER service of the said "RESELLER", who must be contacted in advance, and who will transfer the file for processing to BED REPUBLIC. The CUSTOMER must therefore exchange/communicate for any type of request, with the company in charge of the sale called the "RESELLER", and not directly with the company BED REPUBLIC.
Contact is between the RESELLER and BED REPUBLIC only. The RESELLER will be the contact to whom BED REPUBLIC will respond.
The INDIRECT CUSTOMER having contracted BED REPUBLIC products through these different channels, must also contact the RESELLER CUSTOMER service for any questions and information: order tracking, after-sales service management, warranty, returns, etc.
Direct contact from BED REPUBLIC without going through the RESELLER will result in a systematic refusal of processing.
ARTICLE 10: RETURNS AND WARRANTY
The legal guarantee offered by default on the entire BED REPUBLIC product catalog is 2 years.
BED REPUBLIC offers you a default legal guarantee of 2 years + extended coverage of up to 7 years on a selection of products and/or by subscribing to an additional warranty service or by specific mention specific to the product, which covers all defects noted during the warranty period, caused by the use of defective materials, faulty design or inappropriate manufacturing.
Extended warranty conditions may be offered, depending on the product or range, but also the subscription of additional paid insurance.
Article 10.1 - Prerequisites and verification procedures
Any product defect must be reported immediately after it appears.
BED REPUBLIC products are subject to repair or replacement under warranty, the original warranty period cannot be extended, except in the case of warranty extension or specific mention of warranty extension, outside the legal period of 2 years.
The warranty applies to the product purchased in the territory where BED REPUBLIC officiates its sales. The BED REPUBLIC warranty applies only to the territory defined by BED REPUBLIC, listed in the general conditions of sale. For so-called "specific" areas, the provision may generate additional costs to be borne by the CUSTOMER, or even its inability to guarantee the product (including within the legal period of 2 years).
Depending on the nature of the products, after purchasing a new product to replace an old one, there may be a period of adaptation to the BED REPUBLIC product, i.e. individual feelings of comfort or discomfort when using the product. The same applies to the smell of new products, which disappears after a few days, which can be accelerated by airing the product. It is recommended to air the product when putting it into service, but also during its use as many times as possible.
The CUSTOMER must not remove the manufacturer's sticker, the brand or the BED REPUBLIC label with the product characteristics, and/or the barcode and/or the production batch controller data. Complaints regarding products not bearing these manufacturer / BED REPUBLIC identification labels will not be accepted.
Replacement of the defective product does not extend the initial warranty period.
The application of the guarantee requires a prior investigation: elements necessary for the investigation must be provided. In the event of absence or inability to provide these elements, the processing of the guarantee file cannot be carried out.
Article 10.2 - Procedure for verifying defects to activate the warranty.
The CUSTOMER is required to check the condition of the packaging and the conformity of the product delivered.
In order to avoid any investigation and prosecution, we invite the CUSTOMER to make complaints to BED REPUBLIC concerning a shortage, defect or non-conformity of the goods delivered (noted on the Delivery Note) immediately and within a maximum of 48 hours after delivery of the goods in the event of apparent defects, by sending an email Contact Form explaining precisely the problem(s) encountered, attaching the following elements:
- Overall photographs of your product;
- Precise photographs of the problem(s) encountered;
- Photographs of your annotated delivery note.
- (optional but highly recommended): a video explaining and showing the problem in its entirety, with maximum detail and the elements indicated below. The video does not subscribe to the need for photography requested above, which remains mandatory.
- any other device that can clearly indicate the problem and through the certainty of the verifiable elements sent.
BED REPUBLIC reserves the right to request additional elements and evidence in order to support the evidence already received.
Any refusal to send items or missing items in the analysis of the file may result in a refusal of support.
In any event, the CUSTOMER benefits from the legal guarantees of conformity of the goods to the contract in accordance with articles L217-4 to L217-14 CI Consumer Code, as well as the guarantee of hidden defects of articles 1641 and 1648 paragraph 1 of the Civil Code. The provisions of this article do not prevent the CUSTOMER from benefiting from the right of withdrawal provided for in article 7 above.
Article 10.3 - Legal guarantee of conformity
As part of its General Terms and Conditions, BED REPUBLIC applies the legal guarantee of conformity under the legal conditions provided for this purpose, the provisions of which are reproduced below:
Article L217-4 – Consumer Code
The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
It is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed under its responsibility by the contract or has been carried out under its responsibility.
Article L217-5 – Consumer Code
The property complies with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L217-6 – Consumer Code
The seller is not bound by public statements made by the producer or his representative if it is established that he did not know them and was not legitimately in a position to know them.
Article L217-7 – Consumer Code
Any lack of conformity that appears within twenty-four months from the delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise. For goods sold second-hand, this period is set at six months. The seller may challenge this presumption if it is not compatible with the nature of the goods or the lack of conformity claimed.
Article L217-8 – Consumer Code
The buyer is entitled to demand that the goods conform to the contract. However, he cannot contest conformity by invoking a defect that he knew or could not ignore when he contracted. The same applies when the defect originates in the materials that he himself supplied.
Article L217-9 – Consumer Code
In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
Article L217-10 – Consumer Code
If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded.
The same faculty is open to him:
1° If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month following the buyer's complaint;
2° Or if this solution cannot be achieved without major inconvenience for the latter taking into account the nature of the property and the use that he is seeking.
However, the sale cannot be cancelled if the lack of conformity is minor.
Article L217-11 – Consumer Code
The application of the provisions of Articles L. 217-9 and L. 217-10 takes place without any cost to the buyer.
These same provisions do not prevent the allocation of damages.
Article L217-12 – Consumer Code
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
Article L217-13 – Consumer Code
The provisions of this section do not deprive the buyer of the right to exercise the action resulting from latent defects as it results from articles 1641 to 1649 of the civil code or any other action of a contractual or extra-contractual nature which is recognized by law.
Article L217-14 – Consumer Code
The recourse action may be exercised by the final seller against successive sellers or intermediaries and the producer of the tangible personal property, according to the principles of the civil code .
Article 10.4 - Legal guarantee of hidden defects
As part of its General Terms and Conditions, BED REPUBLIC applies the legal guarantee against hidden defects under the legal conditions provided for this purpose, the provisions of which are reproduced below:
Article 1641 – Civil Code
The seller is liable for the warranty against hidden defects in the item sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
Article 1642 – Civil Code
The seller is not liable for apparent defects of which the buyer was able to convince himself.
Article 1642-1 – Civil Code
The seller of a building to be constructed may not be discharged, either before the acceptance of the works or before the expiry of a period of one month after the purchaser takes possession, from construction defects or lack of conformity then apparent. There will be no reason to terminate the contract or reduce the price if the seller undertakes to repair.
He is liable for hidden defects, even if he was not aware of them, unless, in this case, he has stipulated that he will not be obliged to provide any guarantee.
Article 1644 – Civil Code
In the case of Articles 1641 and 1643 , the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded.
Article 1645 – Civil Code
If the seller knew of the defects in the item, he is liable, in addition to the restitution of the price he received for it, for all damages and interest to the buyer.
Article 1646 – Civil Code
If the seller was unaware of the defects in the item, he would only be required to return the price and reimburse the purchaser for the costs incurred by the sale.
Article 1646-1 – Civil Code
The seller of a building to be constructed is bound, from the acceptance of the works, by the obligations for which architects, contractors and other persons linked to the project owner by a work rental contract are themselves bound under Articles 1792 , 1792-1 , 1792-2 and 1792-3 of this Code. These guarantees benefit the successive owners of the building. There will be no reason to cancel the sale or reduce the price if the seller undertakes to repair the damage defined in Articles 1792, 1792-1 and 1792-2 of this Code and to assume the guarantee provided for in Article 1792-3.
Article 1647 – Civil Code
If the thing which had defects has perished as a result of its poor quality, the loss is for the seller, who will be liable to the buyer for the restitution of the price and for the other compensation explained in the two preceding articles. But the loss occurring by fortuitous event will be for the account of the buyer.
Article 1648 – Civil Code
The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for in Article 1642-1 , the action must be brought, under penalty of foreclosure, within one year following the date on which the seller can be discharged from apparent defects or lack of conformity.
The CUSTOMER may decide to implement the guarantee against defects and hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code. In this case, BED REPUBLIC undertakes, at the CUSTOMER's choice: either to issue a compensatory commercial gesture not exceeding the total amount of the price of the product paid, or to reimburse him for the entire price of the Product (returned or not returned), or to reimburse him for part of the price of the Product if the CUSTOMER decides to keep the Product, or by inviting him to keep his product deducted from a commercial gesture or any other type of agreement.
Article 10.5 - Commercial warranty and after-sales service
As part of its General Terms and Conditions, BED REPUBLIC applies the commercial guarantee as well as the after-sales service provisions under the legal conditions provided for this purpose, the provisions of which are reproduced below:
Article L217-15 – Consumer Code
The commercial guarantee means any contractual commitment of a professional towards the consumer with a view to the reimbursement of the purchase price, the replacement or repair of the good or the provision of any other service in relation to the good, in addition to its legal obligations aimed at guaranteeing the conformity of the good.
The commercial guarantee is the subject of a written contract, a copy of which is given to the buyer.
The contract specifies the content of the guarantee, the terms of its implementation, its price, its duration, its territorial scope as well as the name and address of the guarantor.
Furthermore, it clearly and precisely states that, regardless of the commercial guarantee, the seller remains bound by the legal guarantee of conformity mentioned in Articles L. 217-4 to L. 217-12 and that relating to defects in the thing sold, under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code.
The provisions of Articles L. 217-4, L. 217-5, L. 217-12 and L. 217-16 as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code are reproduced in full in the contract.
Article L217-17 – Consumer Code
After-sales service provision carried out by the seller and not covered by the commercial guarantee referred to in section 3 is the subject of a contract, a copy of which is given to the buyer.
Article 10.6 - Exclusion of warranty
The application of warranty exclusions is managed generally but also by product categories.
Article 10.6.1: Exclusions of specific guarantees
Specific exclusion of any warranty: Custom-made, special or consigned products without a “warranty” due to the “exceptional”, “custom-made” or “unique” criterion of the product, not benefiting from the warranty validity agreement by BED REPUBLIC and clearly stipulated in the sales contract. This includes personalized products, special orders, artisanal orders and custom-made products specifically ordered by the CUSTOMER.
Specific exclusion of any warranty: Products sold by resellers not authorized by BED REPUBLIC.
Exclusion of the warranty extension beyond the applicable legal warranty: Products purchased from RESELLERS, distributors, partner stores, private sales clearance stores, marketplaces or discounters are excluded from a warranty condition other than the legal one: namely 2 years from the date of the purchase invoice, and will be subject to the application of the general terms and conditions of sale of these third-party RESELLERS, the warranty period of which is defined at their convenience, while respecting the legal minimum of 2 years. In the event of a defect or failure to indicate on the part of the resellers/distributors, the 2-year legal warranty applies.
In the case of showcase products, goods purchased at a lower price, the warranty does not apply to defects due to which the lower price was agreed. The warranty for goods purchased at the exhibition will be valid for the remainder of the period, starting from the date of production.
Article 10.6.2: Warranty Exclusions – Not Covered by Warranty
Indirect or incidental damages.
Individual or personal preferences regarding firmness, texture, comfort, individual feelings of comfort or discomfort when using the product.
Subjective feelings of comfort and hardness caused by different weights of CUSTOMERS, illnesses and positions of the CUSTOMER do not constitute grounds for complaint.
The sensation of temperature (heat, hot, cold) generated upon contact with the products, and in particular their coating, is a matter of individual preference and is not covered by the warranty, even in the case of products with thermoactive properties.
Any type of sounds and sound effects emanating from the product, damage to the products resulting from dynamic use of the products or the specificity of the materials used. These elements do not constitute a reason for complaint and return of the product.
Deterioration, damage, failures, negligent handling and transport or visible defects upon delivery which have not been the subject of reservations.
Defects resulting from aging and natural wear and tear outside the scope of the warranty applicable by default or extended.
From improper use or use for purposes other than those for which the product is intended.
Defects resulting from mechanical damage.
Deterioration, damage, failures or defects caused during the installation or assembly of the Products ordered by the CUSTOMER or a third party who did not follow the Product instructions or the brand's instructions.
Damage, failures or defects attributable to causes of external origin, and in particular, abnormal use or use not in accordance with BED REPUBLIC's instructions of the products sold, as well as damage caused by the CUSTOMER or a third party and those due to an unforeseeable event or force majeure.
Deterioration, damage, failures or defects caused by use other than that for which the Product was designed, by improper use, by modification of the construction and/or original characteristics or failure to comply with the assembly instructions, installation guide or maintenance advice.
Any deterioration, damage, failure or defects caused by pets or parasites originating from the CUSTOMER or others.
Deterioration, damage, failures or defects due to the fact that the Products ordered have been stored following delivery/receipt by the CUSTOMER in unsuitable conditions (for example, mold resulting from use or storage in inappropriate conditions).
Costs of commissioning, adjustment, cleaning and testing not resulting from guaranteed damage.
From storage with unopened products outside their original packaging, for a period of more than 3 months,
From storage with unopened products or opening of products in a place that is not suitable, hygienic or suitable for short or long term storage.
From improper storage of the product according to its mechanical provisions: e.g. mattresses stored on their edges, which may become deformed...
Repairs and damages suffered by the Product after a repair carried out by anyone other than a repairer approved by BED REPUBLIC.
Costs of estimates followed or not by repair, costs resulting from unobserved defects.
Makeshift or temporary repairs, as well as the consequences of any possible worsening of the resulting damage.
Damage to the Products resulting from normal wear and tear. The warranty does not cover normal wear and tear such that it does not affect the daily use or safety of the product, nor damage caused by, among other things, theft, falling or impact of an object, fire, discoloration in the light, burns, humidity or excessive dry heat, cuts, scratches, any impregnation by a liquid, or damage engaging the liability of a third party or resulting from an intentional or wilful fault. Normal wear and tear due to the intended use of the products, including caused by washing, such as pilling of fabrics; if the CUSTOMER attempts to alter or repair the product without the agreement and consent of BED REPUBLIC or if attempted to clean the products with inappropriate products or techniques.
Minor imperfections and slight aesthetic defects not reported in the first days of use.
Tears, stains, soiling, burns, liquid damage and discoloration of materials that occur over time.
Products that have been cleaned with improper methods or products, including those caused by washing, such as fabric pilling; in the event of alteration or repair of the product without the consent of BED REPUBLIC or in the event of cleaning of the products, with inappropriate products or techniques.
Individual or personal allergies or sensitivities to the product.
All contamination by fleas, bedbugs or other parasites; if the defect results from a case of force majeure or a natural phenomenon beyond the control of BED REPUBLIC, including, without limitation, fire, flood or natural disaster.
Any physical defect in the product that results in significant cracking or deformation despite normal use and proper handling of the product.
Any product washed or cleaned at least once.
Tears, stains, soiling, burns, liquid damage and discoloration of materials that occur over time.
Moisture, odors, mold, use by animals or other pests of bacterial or animal/insect origin (eg: dog sleeping on the product, All contamination by fleas, bedbugs or other parasites).
The natural stretching of materials after use for more than 6 months. The notion of use cannot be included as a possible claim for products that are dirtier than those resulting from normal use of the product and do not meet hygiene standards.
Damage to closure and fastening systems: zippers, elastic bands or product covers, unless they prove defective immediately after unpacking the goods.
Single, protruding threads or loose stitching that does not limit the usability of the product are not covered under warranty.
Hygiene defects on the part of the CUSTOMER.
Important to consider in the warranty exclusion:
The color of the fabrics of BED REPUBLIC products may change - this cannot be covered by the warranty and is natural due to the use of the product, not affecting the quality of the product.
BED REPUBLIC guarantees that all components used in production have the appropriate safety certificates and are harmless to human health, emphasizing at the same time that it is not responsible for any damage to health if it results from improper use of the goods.
The acquired discoloration of materials such as highly elastic foam, thermoelastic foam, polyester fibers, natural feathers and latex, which is formed by a natural process, does not change the functional properties of BED REPUBLIC products and does not constitute a reason for complaint.
The products are intended for use at indoor temperatures With a temperature of 5 to 30 °C and a relative air humidity of approximately 45 to 60%, and if these conditions are not met, the warranty cannot apply.
BED REPUBLIC products, including removable/flexible/malleable and deformable products (textile, protection, etc., e.g. removable covers), must be washed in accordance with the markings on the labels placed on the products and in accordance with the manufacturer's recommendations. Improper cleaning of the product and the use of harmful agents can permanently damage the materials and render the warranty void.
Article 10.6.3: Exclusion of warranty specific to a specific product or category of products:
These exclusions are in addition to the general warranty exclusions mentioned above.
General bedding category: mattresses, mattress toppers, box springs, pillows, duvets, headboards, bed protection.
The warranty does not cover: exclusions specific to this category
The sleep product warranty (mattress, mattress topper, box spring, bed frame and bed, pillows, duvets, bed linen) does not apply if the products have any sagging or flatness defect that could cause a defect in the product.
Products that have been exposed or have visible damage caused by use on an incorrectly selected, non-original bed frame.
If an abnormal visible imprint or sagging appears on a suitable non-flexible material (list of excluded components such as springs, memory foam, etc.) cannot be covered by the warranty. This refers to a visible imprint when nothing weighs on top of the product. Contact BED REPUBLIC directly by email to CUSTOMER service, because in the majority of cases, it is only aesthetic.
Visible defects, upon delivery and within a maximum of 48 hours or within the first week of use. Beyond this period, any warranty for manufacturing defects will be less legitimate and cannot be the subject of a warranty claim.
Normal wear and tear of the product or its peripherals (cover on a pillow, box spring on a mattress, etc.) as well as situations likely to cause deterioration or damage;
The normal decrease in the firmness of the materials does not affect the general qualities of the product.
Category Mattress, Mattress Covers and Protectors/Mattress Toppers:
The warranty does not cover: exclusions specific to this category
Products that have been misused, such as using an unsuitable bed base or having their characteristics modified.
A mattress that has not regained its stated characteristics after unpacking: mattresses that do not re-inflate cannot be reported more than 30 days after delivery.
Natural subsidence of materials, i.e. subsidence not exceeding 2 cm in height.
A height difference of 2 cm compared to the height described, by nature the materials with “a movement” and their thicknesses which can be variable.
Spring mattresses: Spring and pocket spring mattresses may leave marks or creases on the mattress, which cannot be considered defects as they do not affect comfort.
Natural fiber mattresses: These fibers can cause creases in the fabric or clumps of materials due to their natural nature, and are not covered by the warranty. This is why it is recommended to rotate the mattress at least once every six months.
Important to consider in the warranty exclusion:
Mattresses are suitable for all types of beds, but it is best if they rest on a flat surface that provides support and good air circulation, to maintain the entire warranty period. The use of flexible frames or aerated bases, which naturally extend the life of the mattress, is recommended. The support used has a significant impact on the durability and comfort of use, and therefore on the product warranty.
Mattress covers containing foam materials inside should be given special attention to their washing, clearly following the recommendations of BED REPUBLIC. Dry cleaning or washing with water is recommended, provided that the washing temperature does not exceed 30°C or the temperature indicated on the product label.
Mattress covers and mattress toppers should not be wrung out or mechanically dried at high temperatures due to the specificity of foam materials and fabrics. Failure to properly attach to the mattress can cause excessive moisture penetration, which can cause permanent damage to the foam material. As a result, this can lead to a loss of firmness and softening of the material, thereby losing its properties. It is recommended to use BED REPUBLIC protectors or high-quality protectors with membranes that provide protection and air circulation, which will effectively increase the hygiene of the mattress, reduce the need for pilling of the cover and ensure a proper microclimate during sleep. It is not recommended to use cheap terry cloth sheets.
A product compressed or mechanically emptied of air in the packaging, delivered vacuum-packed or wrapped, requires up to a maximum of 30 days to return to its so-called "initial" shape, and cannot be the subject of a warranty application request only a few days after opening: the most well-known case being mattresses, which need several days to return to their initial shapes and heights as indicated on the technical sheet. It is therefore normal to wait, without having to activate the warranty immediately. Beyond 30 days if the characteristics are not present, please contact BED REPUBLIC customer service.
Bed linen, bath linen:
The warranty does not cover:
Any product that no longer has the original labels present on the new product.
Any product showing signs of use.
Any product washed or cleaned at least once.
Any product not returned in its original packaging, correctly and carefully stored.
Article 10.7: Returns
Article 10.7.1: Return conditions
The CUSTOMER must return the product(s) in the same condition in which they were received, and with all packaging, accessories and instructions (even if the product(s) has/have been unpacked), as soon as possible and at the latest within 14 days from notification of the decision to withdraw from this contract, to the address provided by the BED REPUBLIC CUSTOMER Service.
The cost of returning the product(s) is borne by the CUSTOMER, it is the CUSTOMER's responsibility to choose the carrier who will take charge of the return.
A systematic report of the withdrawal, within the time limits and as quickly as possible, must be made to the BED REPUBLIC services, otherwise the withdrawal may be considered as not supported, or even cancelled.
For any return of goods, the CUSTOMER must have obtained prior agreement from the BED REPUBLIC CUSTOMER service to return the order.
Otherwise, the goods will be automatically refused by BED REPUBLIC services and returned to the sender's address. A single failure to follow the instructions provided in the return agreement will result in its immediate expiration and will cancel the return procedure.
When returning, the products must be carefully packaged, if possible in their original packaging so that they are kept in the best possible condition, following the time elapsed since their purchase. A large and clear label must indicate the maximum amount of information possible, in order to facilitate the task of identifying CUSTOMER returns.
If necessary, visual supporting documents may be requested by BED REPUBLIC Services in order to confirm the condition of the goods at the beginning and end of the return. Upon receipt of the products and after validation of the return by BED REPUBLIC, agreement will be reached: a standard exchange, a credit note or a direct refund may be offered to you, depending on the nature of the return.
The goods can only be returned by Carrier. No direct return will be accepted by BED REPUBLIC Services in order to avoid any transport dispute. The goods must be systematically sent with insurance up to the amount of the returned product. The CUSTOMER must have a legally made purchase with the carrier, to be able to fully justify support and compensation in the event of a CUSTOMER/CARRIER dispute, known as the customer's service provider.
BED REPUBLIC will not be able to take charge of any deterioration or loss of the goods by the carrier selected by the CUSTOMER. In the event that the CUSTOMER does not opt for transport with insurance, only the CUSTOMER's liability will be incurred.
Any return of a product with damage not listed or caused during return transport by the CUSTOMER, will be the responsibility of the CUSTOMER. The CUSTOMER's responsibility will result in a re-examination of his file and a re-evaluation of the file, which may go as far as total refusal on the part of BED REPUBLIC.
Article 10.7.2: Product return terms
The CUSTOMER is free to choose the method of sending their product to BED REPUBLIC warehouses and to take out insurance or not in the event of loss, theft or destruction of their package. BED REPUBLIC cannot be held responsible for non-receipt of the CUSTOMER's package.
The CUSTOMER is responsible for the packaging method of their product, which must be done in such a way that the product can travel without risk of breakage or damage. BED REPUBLIC therefore advises the CUSTOMER to insure their shipments for the value of their invoice.
Any return of an incomplete, damaged, damaged or soiled item by the CUSTOMER will be considered non-compliant. It will not be refunded and will be returned at the CUSTOMER's expense.
Products that have been unpacked and have resumed their usual shape, and which by this means, cannot be repackaged, will therefore not be able to fall within the framework of a classic withdrawal, unless agreed by BED REPUBLIC. In this type of case, mediation with BED REPUBLIC will be necessary, and the CUSTOMER, according to the nature and responsibility of the return defined, will have to pay for transport accordingly according to the volume of the unpacked and/or assembled product.
Any return accepted by BED REPUBLIC CUSTOMER service will result in the reimbursement of the sums paid after qualitative verification of the returned products, after notification and confirmation of its return.
Proof of delivery will be requested and is mandatory in order to confirm the return.
PLEASE NOTE: Additional supporting documents (photographs for example) may be requested from the CUSTOMER when returning the package and the product. The CUSTOMER must take as much evidence as possible in order to justify the return procedure as much as possible.
Article 10.8: return of the product through the CUSTOMER Right of Withdrawal
In the event of exercising the right of withdrawal, the direct costs of return will be borne by the CUSTOMER.
The CUSTOMER may, if they wish, use the services of BED REPUBLIC carriers to collect their order. In this case, contact CUSTOMER Service via the Contact Form .
Please note that the CUSTOMER remains free to choose their carrier and that BED REPUBLIC offers an optional and non-obligatory service here.
The amount of the return costs will be calculated based on the type of product and the distance to be covered by the carrier to collect the product and return it to the warehouse. They may be higher than the costs paid by the CUSTOMER when purchasing.
An application fee will be required for this procedure.
Some areas or countries are not eligible for recovery, due to the absence of transport providers. BED REPUBLIC will advise that recovery is impossible through them, and will ask the CUSTOMER to find a solution through them. BED REPUBLIC in this case, could not be responsible for any possible additional costs or fees.
The repatriation by BED REPUBLIC of products in the so-called specific zones is not currently available.

Article 10.9 – Warranty for products purchased via partner networks
Any order for our products via RESELLERS: reseller, distributors, agents, stores and partner online sales SITES, marketplaces, private sales, discounters or clearance sellers, must be managed by the CUSTOMER service of said “RESELLER”.
The CUSTOMER being considered here as an INDIRECT CUSTOMER having purchased BED REPUBLIC products via a channel other than that of the SITE or direct contract with BED REPUBLIC, the INDIRECT CUSTOMER is then invited to consult the conditions of sale of the RESELLER, which will be those applicable to the sales contract and the guarantee.
The warranty applied is that applied by the partner, defined by its commercial policy and by default for the reseller systematically 2 years. It is advisable for the CUSTOMER called "indirect CUSTOMER" to inquire with the RESELLER in question. Note that in this case, for BED REPUBLIC, the applicable warranty is by default 2 years.
No warranty extension is granted by BED REPUBLIC to its partners, who are responsible for the warranty conditions displayed in their general terms and conditions of sale.
BED REPUBLIC cannot be held responsible, due to the absence of a direct contract with the INDIRECT CUSTOMER, for processing, guarantees or applications of the general conditions of sale, for sales of BED REPUBLIC products made by its RESELLER partners.
In the event of direct contact from the BED REPUBLIC CUSTOMER service of a so-called INDIRECT CUSTOMER, without going through the RESELLER, BED REPUBLIC will not be authorized to process the request, and consequently, the request will remain unprocessed and unanswered.
Article 10.10 – Application of the non-conformity guarantee by taking measurements of the product.
Article 10.10.1 – Taking measurements
Due to the soft materials and production technologies used to produce BED REPUBLIC products, a possible tolerance is issued on the product and must be accepted by the CUSTOMER.
BED REPUBLIC grants itself a variation margin on the height/width/length of the Mattresses, mattress toppers, pillows and duvets products, in an optimal condition of use of the product, corresponding to the degree of movement/density of the materials and the difference accepted for this category of products.
Article 10.10.2 – European standard technical conditions
Complaints regarding length, width and thickness measurements within the tolerance limits of European regulation UN / EN 1334 will be considered if the indicated size of the mattress or pillow is exceeded by more than 1%.
Normal settlement of internal layers ranging from +0 mm/-20 mm. Loss of firmness and hardness up to 15% (standard UNE / EN 1334: 1996) PN- EN 1334: 2001.
Length/Width/Height for the categories mattresses, mattress toppers, pillows, duvets, padded protectors, furniture: 2cm of beating.
Article 10.11 - Warranty extension - up to 7 years warranty.
BED REPUBLIC we offer a 7-year warranty on the dimensional stability and durability of the main materials.
The warranty covers any defects found during the warranty period, caused by the use of defective materials, faulty design or improper manufacturing.
The warranty extension allows the applicable warranty to be extended for a period longer than the default legal warranty of 2 years.
The warranty extension does not allow access to conditions already previously excluded, following the list of exclusions previously cited.
The 7-year warranty extension only applies to direct purchases with the company BED REPUBLIC (invoicing data of the seller BED REPUBLIC on the purchase invoice is authentic) on the SITES owned by BED REPUBLIC SAS (www.bedrepublic.eu , www.sommeil-et-tradition.com , www.leonis-literie.com ), BED REPUBLIC's own stores, and cannot apply to RESELLERS: distributors, partner stores, private sales clearance stores, marketplaces or discount stores,

Article 10.11.2 - Products associated with the extension up to 7 years of warranty:
Mattresses, box springs, headboards, bed frames, mattress toppers labeled BED REPUBLIC, Sommeil et Tradition, Leonis, Maison Couleurs, Pastel Literie and Nuage Nuage, sold under the BED REPUBLIC brand, unless otherwise indicated.
For any product or product category not present in this list, the warranty applicable by default is the 2-year legal warranty and cannot benefit from an extension.
Article 10.11.3 – Subscription to extended warranty insurance up to 7 years of warranty:
The CUSTOMER may take out Extended Warranty insurance, for a variable duration of their choice, limited to 7 years, allowing the default 2-year warranty to be extended to a specific product category.

ARTICLE 11: RETURN OF PRODUCTS
Remember, before requesting a return: think about sorting, reusing, reselling, donating or recycling.
Above all, resell or give away! Because some products, even if you don't like them anymore, can last a lifetime, and you can have several!
Article 11.1 - Return of the old product
When purchasing a product, you can return your used equipment (of the same type and equivalent dimensions) free of charge so that it can be reused, recycled and/or recovered in accordance with the rules in force.
The take-back is offered by BED REPUBLIC according to the following terms and conditions, set up in collaboration with eco-organizations approved by the State: The free take-back of used products by the distributor (Article L. 541-10-8 of the Environmental Code (version applicable on January 1, 2022) \'':\'' The distributor must take back or have taken back by a third party, free of charge, used products that the end user discards, within the limit of products of a nature and dimensions equivalent to those offered for sale by the distributor.
This return must be made at the same time as the delivery of the product ordered.
This is why the CUSTOMER must request to contact BED REPUBLIC without waiting before or after their order (immediately), so that we can organize the collection upon your delivery.
A recovery survey will be carried out systematically.
In the event of incompatibility of recovery or difficulties following the feasibility study, or disagreement on the nature of the product to be recovered, BED REPUBLIC will be entitled to cancel the order without conditions, if the recovery condition is an obligation for the CUSTOMER.
ARTICLE 11.2 - Conditions of application for the return of an old product.
The return only applies in the case of a new order, confirmed and paid, of a BED REPUBLIC product, purchased directly from the company BED REPUBLIC SAS, invoice supported by the company BED REPUBLIC SAS.
The recovery may not be the subject of a transaction request on the part of the CUSTOMER. It is considered a free gift with complete, irrecoverable and irrevocable loss of ownership.
Important point: and this even in the event of a future dispute!
In accordance with the AGEC law, “Anti-Waste for a Circular Economy”, taking effect on January 1, 2022, BED REPUBLIC takes back old furniture to fight against waste and develop donations and solidarity reuse.
When the CUSTOMER purchases a bulky piece of furniture via BED REPUBLIC and its websites, the company BED REPUBLIC may take back the CUSTOMER's used product free of charge upon delivery to their home of their new order or at a time other than that of delivery of the new product(s) ordered, whether they are BED REPUBLIC products or products from other brands, according to the conditions established in the articles below.
The return conditions do not apply in the context of a reseller, an agent, a store or a SITE reselling BED REPUBLIC products. Only in the context of a direct purchase with the company BED REPUBLIC. In these different cases, please contact the RESELLER company that sold the BED REPUBLIC products, which will be in charge of this return procedure.
Article 11.3. Conditions for the Return of a Bulky Item of Furniture
The furniture must be bulky (length + width + height greater than 2 meters or weight greater than 30 kg) and must not be able to be transported without equipment.
Used furniture must be of the same type as the furniture purchased and delivered. For example, if you buy a mattress, BED REPUBLIC takes back an old mattress and not an old sofa…
The used furniture must be of the same quantity as the furniture purchased and delivered. The return will be based on the principle of one piece of furniture purchased = one piece of furniture returned.
The furniture must be dismantled before the takeover: the panels must be dismantled; only the screws can be kept. The feet of a bed base or the slats for example. The elements making up the used product to be taken back will be gathered in the same place, in an accessible manner.
Used furniture must not affect the practicality, safety and health of the carrier (risk of cuts, flammable products, hygiene conditions, insects, access difficulties, impossibility of handling, removals, etc.). The carrier will be entitled to refuse to take back your furniture if it does not comply with the conditions detailed above.
The recovery of the old furniture must be possible upon delivery of the new product, during the same operation. In the event that the old furniture to be recovered is unavailable at the time of delivery, the recovery cannot be carried out at a later date.
The collection of the old furniture will take place at the same location as the delivery of the new product.
If the new furniture is delivered to the doorstep, the collection of the old furniture will be at the doorstep at the foot of the truck. The used product must therefore be made available to the delivery person at the foot of the truck.
If the new furniture is delivered to the room of your choice, the collection of the old furniture will take place in the room of your choice.
In the event of withdrawal once the free return has been made, the CUSTOMER abandons his right to the old furniture taken back upon delivery of the new furniture. In addition, return costs will be taken from the amount refunded to the CUSTOMER.
If the return concerns a mattress or soft furniture such as sofas/armchairs, upon delivery of your new mattress or soft furniture, you must cover the product for hygiene reasons. The carrier will be entitled to refuse the return of your used furniture or mattress if it does not comply with the conditions detailed above.
If all of the above conditions are met, to benefit from the collection of your used furniture or mattress upon delivery to your home, please follow the procedure below:
Send a written request within a maximum of 2 hours after placing your order to the address contact@BEDREPUBLIC.fr, indicating:
Subject: AGEC RESUMPTION.
Full order number,
Name and surname, full address, availability of the CLIENT
Type of furniture to be taken back (box spring, bed, headboard, etc.),

The CUSTOMER must make themselves available, friendly and courteous, and make themselves available as close as possible to the collection truck through them, by showing themselves to be helpful and not passive, to facilitate the work of the operators/carriers in charge of the collection. Failure to comply with these rules will result in a firm and definitive refusal of collection, and travel and non-collection costs will be applied, even in the event of non-completion of collection.
Any missed slot or customer unavailability not issued within 48 hours in advance will result in a definitive refusal of support, and travel and non-support costs will be applied.
Failing this, BED REPUBLIC will not be able to guarantee the recovery of the product by its carriers.
Any request made more than 2 hours after placing the order cannot be returned.
11.4. Conditions for the return of a small product or small piece of furniture
BED REPUBLIC does not take back your old small product or used furniture upon delivery. A small piece of furniture is a piece of furniture whose weight is less than 30 kg or its dimensions (length + width + height) are less than 2 meters or, with the possibility of being flexible and folded making these conditions of dimensions and weight possible (mattress topper for example...).
Pillows, duvets, bed linen, mattress toppers, towels, protection, accessories are mainly non-returnable products, which can be placed in suitable collection bins.
You can drop off your small used product or small piece of furniture at a collection point free of charge. The list of collection points is available on the following SITES:

11.5. Product return at the discretion of the CUSTOMER, excluding right of withdrawal.
The CUSTOMER may, if they wish, use the services of BED REPUBLIC carriers to take back their old product, with no condition other than a purchase on the SITE of a product of a type equivalent to that to be taken back.
The recovery costs will be borne by the CUSTOMER.
In this case, the costs are specific to each case, and it is mandatory to contact CUSTOMER Service via the contact form, in order to confirm whether the basic pricing displayed below is suitable for the case of recovery requested by the CUSTOMER.
The amount of the costs will be calculated based on the type of product and the distance to be covered by the carrier to collect the product and return it to the warehouse.
An administration fee will be mandatory for this procedure.
Table of return costs according to the applicable product type: attached is the price list, per unit, including tax – update 2024.
Fees may vary depending on the nature of the request, but also on the area. This is why it is imperative, if the CLIENT wants this service, that a preliminary study be carried out before any action.
The service will only be carried out after agreement and complete study carried out by the BED REPUBLIC services, with clear and complete elements, duly provided by the CLIENT and validated as compliant by BED REPUBLIC.
ARTICLE 12: RETENTION OF TITLE CLAUSE
In accordance with Article L 624-16 paragraph 2 in fine of the French Commercial Code and Articles 2367 et seq. of the French Civil Code, it is expressly agreed with the CUSTOMER that the transfer of ownership of our Products is suspended until full payment of the price, the CUSTOMER agreeing to submit to the provisions of the Law of 12/5/1980.
The CUSTOMER undertakes to allow the identification and claiming of the goods at any time.
ARTICLE 13: INTELLECTUAL PROPERTY
All texts, comments, works, graphics, illustrations and images reproduced on the BED REPUBLIC SITE are reserved under copyright and intellectual property law. All elements of the SITE are and remain the exclusive property of BED REPUBLIC or the holders of said rights who have granted an exploitation right to BED REPUBLIC.
Content means all visual, audiovisual and written information that appears on the SITE, including all graphics, photographs, drawings, iconography, animations, videos and text (collectively, the “Content”).
As such and in accordance with the provisions of the Intellectual Property Code, none of the content that appears or is available on the SITE may be, in whole or in part, copied, reproduced, represented, used, republished, downloaded, posted, transmitted or distributed in any way whatsoever without the prior written consent of BED REPUBLIC.
Any total or partial reproduction of the WEBSITE published by BED REPUBLIC by any means whatsoever is strictly prohibited. It would constitute an infringement punishable by articles L 335-2 and following of the Intellectual Property Code.
Any person who has a personal website and who wishes to place, for personal use, on his/her website a simple link directly to the home page of the website, must request authorization from BED REPUBLIC. This will in no case be an implicit affiliation agreement.
The code and software underlying our WEBSITE are the exclusive property of BED REPUBLIC and are protected by applicable industrial property laws. The user is not authorized in any case to use said program and code for purposes other than the normal use of the WEBSITE.
All trademarks, logos, service marks, trade names, trade dress and other distinctive marks or signs of devices (collectively, the “Marks”) displayed on the WEBSITE and/or the BED REPUBLIC Products (collectively, the “BED REPUBLIC Marks”) are the exclusive property of BED REPUBLIC and are protected by applicable intellectual and industrial property laws.
In some cases, we may display Marks owned by third parties with whom we have established a business relationship.
If you are a member of a media outlet, you may use the content on our press page without our prior written permission. In such case, the content may only be used for legitimate, accurate, non-commercial purposes that are not likely to cause confusion as to the source, sponsorship and/or affiliation of BED REPUBLIC or BED REPUBLIC Products and its brands.
The brands BED REPUBLIC, H.REPUBLIC, LEONIS, LEONIS LITERIE, SOMMEIL et TRADITION, NUAGE NUAGE, MAISON COULEURS are registered trademarks at EUROPEAN level or more (depending on the brand), of which BED REPUBLIC SASU has full exploitation.
ARTICLE 14: RESPONSIBILITY
Article 14.1. Liability for the sales contract
The products offered on the BED REPUBLIC SITE comply with current French and European legislation and with the standards applicable in France and Europe.
The liability of BED REPUBLIC is, in any event, limited to the amount of the order and cannot be called into question for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products and the execution of the service by the company BED REPUBLIC.
BED REPUBLIC shall not be liable to any member or third party for any indirect damage, loss of business, profit, turnover, indirect, incidental, special, exemplary, punitive or consequential damage, including loss of data, personal injury or property damage, occurring in any way whatsoever, even if this damage or loss or harm was foreseeable and/or informed to or by BED RPEUBLIC, or if its possibility had been brought to its attention.
Article 14.2. Product liability and sales SITE
The quality, definition or lighting of the photo, as well as the calibration of your computer screen, may lead to minimal variations in the representation of the products presented for sale.
BED REPUBLIC cannot be held liable for any damage whatsoever resulting from a professional activity.
BED REPUBLIC has only an obligation of means in all stages of access to the SITE, visit, entry of forms, placing of orders, preparation of orders, delivery of orders, returns of products and reimbursements of orders to be reimbursed.
BED REPUBLIC cannot be held liable for any inconvenience or damage inherent in the use of the Internet and external to the precautions taken by the company.
BED REPUBLIC shall not be held liable for any cases of force majeure, external intrusion or the presence of a computer virus.
ARTICLE 15: DATA PROTECTION ACT – Cookies Policy
Article 15.1. Obligations and retention of CUSTOMER data
Placing an Order requires the CUSTOMER to provide a certain amount of personal data concerning them (identity, email address, delivery and billing address, data relating to means of payment, etc.).
In general, the information collected by BED REPUBLIC is essential to respond to the CUSTOMER's requests. If the CUSTOMER does not fill in these mandatory fields, BED REPUBLIC will not be able to respond to his requests. The data identified as mandatory is necessary for processing Orders as well as for managing and monitoring BED REPUBLIC's commercial relations with its CUSTOMERS.
In application of law n°78-17 of January 6, 1978 , it is recalled that the personal data requested from the CUSTOMER are particularly necessary for processing their order and establishing invoices.
The Company implements processing of personal data.
The legal basis for the processing of personal data implemented is:
* The execution of pre-contractual measures or of the contract when it implements processing for the purpose of:
- The production, management and monitoring of its CLIENTS' files;
- The recovery.
* Compliance with legal and regulatory obligations when implementing processing for the purpose of:
- Prevention of money laundering and the financing of terrorism and the fight against corruption;
- Billing;
- Accounting.
The data processed is intended for authorized persons of the Company.
The CLIENT has, in accordance with current national and European regulations, a permanent right of access, modification, deletion, limitation, rectification, portability, as well as a right to object to the processing of information concerning him/her, which he/she may exercise by sending a registered letter with acknowledgment of receipt to the Company's head office.
The persons concerned have the right to lodge a complaint with the National Commission for Information Technology and Civil Liberties (CNIL).
Article 15.2. Application of data for commercial purposes.
This information and data may also be used by BED REPUBLIC for internal statistical purposes, in particular to enable BED REPUBLIC to improve the quality of services and better meet the expectations of CUSTOMERS. In addition, the CUSTOMER may receive by email or SMS, from BED REPUBLIC, offers relating to Products or services similar to those or the one that has already been the subject of an Order. He will have the option at any time to oppose them without charge for the future, according to the terms specified in each sending. Without prejudice to the foregoing, the CUSTOMER is informed that he may, if he wishes, register free of charge on the telephone canvassing opposition list.
Article 15.3. Recipients of personal data
This CUSTOMER data may be communicated to third parties, linked to the company by contract and in particular to any partners of the Company responsible for the execution, processing, management, delivery and payment of orders.
Personal data is not used for any commercial purpose by third parties. The databases relating to the storage of CLIENT information are not created for the purpose of resale or commercial exploitation by a third party. The personal data collected is intended for use by BED REPUBLIC and may be transmitted confidentially to service providers acting on behalf of BED REPUBLIC, in particular to enable the processing of the purposes presented above.
Article 15.4. Security of personal data
BED REPUBLIC strives to implement all useful precautions and appropriate organizational and technical measures to preserve the confidentiality and security of the personal data processed and to prevent them from being distorted, damaged, destroyed or accessed by unauthorized third parties.
Credit card data Credit card data transmitted during purchases will be communicated directly to the payment service provider as a bank or financial operator and not to the seller.
Therefore, the Supplier does not store data relating to the payment instruments used by the CUSTOMER, which will be transmitted directly to the third-party provider that manages the payment services.
Article 15.5. Duration of storage of personal data
The Company retains the data for the duration necessary for the operations for which they were collected, as well as in compliance with the regulations in force.
In this regard, CUSTOMER data is kept for the duration of the contractual relationship plus 10 years for the purposes of promotion and prospecting, without prejudice to retention obligations or limitation periods. In accounting matters, it is kept for 10 years from the end of the accounting year.
The data controller is the company BED REPUBLIC SASU 8 bis rue Abel 75012 PARIS - France.
Beyond the commercial relationship, if BED REPUBLIC wishes to use this data for analysis purposes or to produce aggregated statistics, the data will be irreversibly anonymized by purging all personal data, including indirectly identifying data.
For the data of non-CUSTOMER Prospects and persons who have registered on the SITE without placing an Order (hereinafter “Non-CUSTOMER Prospects”) are kept for a period of 5 years from their collection or from the last contact from the non-CUSTOMER Prospect, unless the account has been deleted before. In any event, the data will be deleted as soon as the account is deleted.
Article 15.6. Cookies policy
The CLIENT expressly authorizes BED RPEUBLIC to place a file called a “cookie” on the CLIENT’s hard drive.
This "cookie" is intended to facilitate the collection of statistics, the recognition of the CUSTOMER and its identification in the "my account" area of the SITES of the company BED REPUBLIC. A cookie does not allow BED REPUBLIC to identify a CUSTOMER by name. In general, it records information relating to navigation on the SITE, so that the CUSTOMER can read it during subsequent visits.
This data is strictly intended for internal use by BED RPEUBLIC and is not communicated to third parties.
The CUSTOMER may oppose the use of cookies by configuring their browser.
Some cookies are advertising cookies that allow the products viewed to be recorded in order to present advertising banners in accordance with the CUSTOMER's interest within a maximum period of 90 days.
ARTICLE 16: MEDIATION – DISPUTE RESOLUTION
In accordance with article R 612-1 of the consumer code, the CUSTOMER may use the mediation service free of charge, electronically.
For all complaints already filed in writing with the seller's CUSTOMER service less than a year ago and not satisfied.
In order to facilitate the rapid and efficient processing of your written complaint, we recommend that you title your email or postal letter "Complaint prior to any referral to the mediator", and provide our complaints department, Contact form , with the following information:
- your contact details: title, first name, last name, postal address, email address, the telephone number at which you can be reached and your availability times
- the number and date of the invoice corresponding to your purchase, or, failing that, the product concerned, the date and method of purchase, the method of payment, the date and method of delivery
- the reason for the complaint (late delivery, incomplete delivery, defective or damaged product, imperfectly executed service, etc.), when the defect was visible upon delivery, you can attach a photograph showing it. You can also attach all documents useful for understanding your complaint (contract, general terms and conditions of sale, etc.)
- your exchanges (emails, letters, faxes) with the professional
- the solution envisaged: replacement or repair of the product, price reduction, claim for damages, termination of the contract, etc.
MEDIATION: For all complaints already filed in writing with the seller's CUSTOMER service less than a year ago and not satisfied, in accordance with article L.616-1 of the consumer code, the CUSTOMER may use the CMAP mediation service free of charge, either:

ARTICLE 17: APPLICABLE LAW – DISPUTES
BED REPUBLIC's primary desire is to never have any dispute of any nature whatsoever with its CUSTOMERS.
However, if any dispute or claim arises as a result of these Terms, the WEBSITE, the purchase of products or your use by the CUSTOMER of any services available on the BED REPUBLIC WEBSITE, the following rules and procedures will apply.
Contracts resulting from purchase and sale transactions concluded through the seller's SITE are subject to French law. Any breach of any of the rules of this contract will result in legal proceedings before the competent courts.
Article 17.1. Dispute Resolution:
Both parties (BED REPUBLIC and its CLIENT) agree that they will attempt, in good faith, to resolve any dispute or controversy informally.
If for any reason the CUSTOMER wishes to initiate this informal process, the CUSTOMER must submit a notice clearly marked “Notice of Dispute” and must contain its name, address and contact information, a brief but clear explanation of the complaint/dispute, indicating the resolution the CUSTOMER seeks.
All notifications should be sent to contact@bedrepublic.fr.
BED REPUBLIC will contact by email at the address that the CUSTOMER specified in its notification or at the physical address that BED REPUBLIC stored when placing an order on its WEBSITE. Both parties (BED REPUBLIC and the CUSTOMER) agree to make all reasonable efforts to resolve any dispute in good faith through dialogue and negotiation within sixty (60) days of the formal notice. If the dispute is not resolved within sixty (60) days of filing, either party may resort to the procedures described further in this section.
17.2. Failure of the claim:
In the event of failure of the complaint request to the CUSTOMER Service or in the absence of a response from this service within sixty (60) days, the CUSTOMER has the possibility of resorting to a consumer mediator with a view to the amicable resolution of the dispute between him and BED REPUBLIC.
In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator.
The mediator must be contacted within a maximum period of one year from the initial complaint. See article 16 for information on mediation.
17.3. Right to refer the matter to the judge:
The courts of Paris (place of domicile of BED RPEUBLIC) will be the competent courts.
ARTICLE 18: Membership of the eco-participation
BED REPUBLIC is registered in the National Register of Producers of Furnishing Elements - the Environment and Energy Management Agency (ADEME) under number FR356614_10NOJC
And
to Extended Producer Responsibility (EPR) for household packaging under number FR356614_01KEWY (CITEO).
These identifiers guarantee that BED REPUBLIC, by adhering to Éco-mobilier and CITEO, is in compliance with the regulatory obligations incumbent upon it under articles L541-10 et seq. of the Environmental Code.
BED REPUBLIC is registered in the REFASHION register.
